3. Continuity and Accuracy of Services

3.2 The Customer acknowledges and agrees that the availability of the Services is dependent on several external and environmental factors beyond the reasonable control of The Business Library. In the event that the Services are temporarily unavailable, both The Business Library and the Customer acknowledge and agree to the following:

  • The Business Library will make every effort within its commercial capabilities to restore the Services as quickly as possible;
  • The Business Library cannot be held liable for any failure or interruption of service;
  • from time to time, The Business Library will conduct routine upgrades and general maintenance on the Website and its associated software

3.3 The Customer acknowledges and agrees that The Business Library may suspend the Services if the Customer breaches any of these Terms, if required to do so by law, or if requested by any relevant Government Agency.

4. Customer Acknowledgements and Responsibilities

4.1 The Customer acknowledges and agrees that whilst using the Service you:

  • are solely responsible for verifying the accuracy of any information submitted to The Business Library;
  • are solely responsible for ensuring that the documents you purchase are downloaded and stored securely on your computer network. If a purchased document does not download correctly, you agree to contact us within three (3) hours of purchase to either (i) have the document resent or (ii) request a refund;
  • acknowledge that The Business Library is not responsible for any documents once they have been purchased and downloaded;
  • are responsible for all costs associated with the documents you purchase and download.
5. Fees and Services

5.1 The Customer acknowledges and agrees that while using the Service:

  • a fee is due and payable each time a new document is purchased and downloaded;
  • the fee includes a Goods and Services Tax (GST) currently charged at 10% in accordance with Australian Taxation Office laws;
  • The Business Library reserves the right to vary the fees at any time without prior notice. It is your responsibility to ensure that you are aware of the fee applicable before purchasing any documents.

5.2 The Customer acknowledges and agrees that once you have submitted an online purchase, you are not entitled to any refund concerning:

  • changes made to any document after download;
  • accidental loss or deletion of any documents after download;
  • updates to documents on the website that may render previous versions void or irrelevant.

5.3 To the extent permitted by law, The Business Library reserves the right to reject any application for a refund.

6. Intellectual Property

6.1 The Customer acknowledges and agrees that:

  • The Business Library retains exclusive ownership and control of the intellectual property in all software and content (including legal documents) made available to you on or through our Website;
  • we expressly reserve all copyright in our Website and in all content contained therein;

  • your purchase includes a single-user, non-transferable license for personal or business use. You may not resell, redistribute, or share the documents you have purchased.
7. Governing Law

7.1 The Terms and Conditions are governed by, take effect under, and will be construed in accordance with the laws of South Australia. The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of South Australia and the courts entitled to hear appeals therefrom.

7.2 The Customer hereby releases The Business Library and its agents, servants, contractors, and employees, to the full extent permitted by law, from all claims and demands of every kind resulting from any loss or damage to the applicant, or any persons related to the applicant, arising from the operation of the Service, the failure to operate the same, or any other matter arising out of these Terms and Conditions, including force majeure.7.3 The Customer and all other visitors to the website acknowledge and agree that no part of the website may be copied or imitated in whole or in part. No logo, graphic, image, or sound from the website may be copied or retransmitted unless expressly permitted in writing by The Business Library. The information contained within this site is also subject to the same copyright conditions and cannot be copied, imitated, or used, in whole or in part, without the permission of The Business Library.
